Where unionized employers and unions are unable to resolve a workplace dispute, they have the option of submitting the dispute to an independent arbitrator or an arbitration board. When a decision is rendered, the resulting arbitration award is filed with the Labour Relations Agency.

WHSCRD was established in 1994 by a legislative amendment to the Workplace Health, Safety and Compensation Act (the Act) and is the final level of review within the workers’ compensation system in the Province. WHSCRD is an independent, quasi-judicial body, consisting of a panel of Review Commissioners and a Chief Review Commissioner.

The Workplace Health, Safety and Compensation Review Division (WHSCRD) is an independent, quasi-judicial body that considers appeals arising from decisions of WorkplaceNL. The appeals process for clients of WorkplaceNL is vital to the overall service provided to employers and to workers who sustain workplace injuries in Newfoundland and Labrador.
